On the land-based front, we do not expect too much expansion. With the launch of the William Hill Sports Book at Tropicana Casino, there is only two candidates left in Atlantic City to start books. One, Hard Rock Casino, we expect to go live with a retail publication this year, as Hard Rock has already signed a Letter of Intent with Gaming Innovation Group to an omni-channel sportsbook platform.
As mentioned, Freehold Raceway, owned by Penn National Gaming and Greenwood Gaming (proprietor of Parx Casino in Pennsylvania) is also a prime candidate to enter the land-based sports gambling kingdom.
On the internet front, there’s a lot more room to maneuver as every sports betting license holder is entitled to three branded websites, or skins. Some, like Monmouth Park and Resorts AC, have already debuted two skins, but many others, including heavyweights Tropicana, Hard Rock Casino, and Golden Nugget, haven’t launched any. Expect multiple AC-branded online sportsbooks to pop up in the not-so-distant near future, and for different companies such as the Kindred Group (currently aligned with Hard Rock Casino) and Australian-based PointsBet (partnered with all the Meadowlands) to also launching online books in New Jersey.
When the smoke clears it won’t be unheard of to find upwards of 30 online sportsbooks at New Jersey.
Regulations, taxes, and revenue It was only a few brief weeks after the U.S. Supreme Court kicked PASPA to the wayside which New Jersey passed sports gambling legislation. The bill passed by unanimous vote in both chambers and was signed into law by Governor Phil Murphy (who also happened to put the initial bet at Monmouth Park after that week) on June 11.
Regulation of this industry was handed off to the NJ Division of Gaming Enforcement, the same agency that handles oversight for Atlantic City casinos and internet gambling websites in New Jersey. Luckily, the state had been primed to supply sports betting for several years, enabling regulators to release emergency regulations just two days after Murphy penned the sport betting bill into legislation.
New Jersey law mandates that only qualified casinos and racetracks be qualified for a sports gambling license, and that online sportsbook operators have to be partnered with a license holder. Other factors of interest:
The fee for a sports wagering license was put at a minimum of $100,000
The tax rate is set at 8.5percent for land-based venues, and 13% for online sites, with horsemen required to pay an additional 1.25% to the Department of Local Government Services at the Dept. of Community Affairs.
Permit holders are restricted to three individually branded sites, or skins.
Wagering on college sports is allowed, unless a New Jersey college or college group is involved. Then it’s a no-go.
Permit holders have a 270-day window (transactional waiver) to operate online sportsbooks in the absence of a physical sportsbook.
New Jersey doesn’t cover an ethics fee to professional sports leagues in exchange for league and data supervision, nor will it likely ever.
In terms of handle, New Jersey books took $184 million in bets during September 2018. And out of June — September, the industry generated over $40.4 million in earnings. Word is still out on exactly how large the industry will get, since there are still a great deal of books that haven’t launched yet, and many prospective bettors are still unaware of the distinction between legal and offshore sites, or that legal sports gambling is even a thing. A brief history of New Jersey sports betting New Jersey’s battle to legalize sports betting within its borders extends all of the way back to 2009, when State Sen. Raymond Lesniak introduced sports gambling legislation. His bill would easily pass via voter referendum in 2011, resulting then Governor Chris Christie to pass it into law the next year.
Regrettably there was one massive roadblock, which was the Professional and Amateur Sports Protection Amendment (PASPA) of 1992. Soon after sports gambling regulations were posted in August 2012, professional sports leagues filed a suit against Christie and New Jersey. The upcoming few years were riddled with disappointment for New Jersey, since it lost in the district courts, then twice in the Third Circuit Court of Appeals. Then in June 2014, the nation was delivered yet another devastating blow, if the U.S. Supreme Court refused to accept New Jersey’s appeal.
Additionally in 2014, the constantly staunch gambling proponent Lesniak went to work on new sports gambling legislation that would function as a sort of PASPA workaround. The same effect, with New Jersey and Christie once again losing to the leagues at the courts. However, by this time, the prevailing attitude toward sports betting was starting to show some cracks. Five-and-a-half month after, on May 14, 2018, the Court announced its decision, voting 7-2 which PASPA violated the 10th amendment, and deeming it entirely unconstitutional by a 6-3 count. Just a couple of weeks later, New Jersey passed a new sports gambling bill, also at a ribbon cutting ceremony at the Monmouth Park sportsbook on June 14, 2018, the industry was born.Today, it stinks.
